EARTH & ELEVATE MOVEMENT STUDIO LLC, E&E BOOSTER CLUB, EARTH & ELEVATE YOGA COOPERATIVE CLIENT’S REPRESENTATIONS, WARRANTIES & RELEASE OF LIABILITY I hereby voluntarily agree, personally or on behalf of the minor child named above, to participate in individual and group fitness and aerial classes, rehearsals, workshops, events, and/or performances (collectively, the “Activities”) offered or administered by Earth & Elevate Movement Studio LLC and/or E&E Booster Club, and their respective owners, members, managers, officers, employees, independent contractors, guest instructors, volunteers, agents, representatives, successors, assigns, affiliates, and any other individuals or entities engaged by Earth & Elevate Movement Studio, LLC (individually and collectively, “Earth & Elevate”). If signing on behalf of a minor, I understand that all references to “I,” “me,” and “my” in this document apply to the minor participant. I declare that I am physically and mentally sound and not suffering from any condition, injury, impairment, disease, infirmity, or other illness that would prevent my participation in the Activities. I acknowledge that Earth & Elevate has recommended that I obtain a physician’s approval prior to participation, and again should my condition change. I understand that Earth & Elevate instructors and staff are not medical professionals, and any guidance provided is not a substitute for medical advice. I acknowledge and accept that participation in the Activities involves inherent risks, including but not limited to physical injury, illness, property damage, and death, as well as risks that may not be known or reasonably foreseeable at this time. In consideration of being allowed to participate, I hereby waive, release, discharge, and covenant not to sue Earth & Elevate for any and all liability, claims, demands, causes of action, or expenses (including reasonable attorneys’ fees) arising from or related to my participation in the Activities, whether caused by negligence or otherwise, except in cases of gross negligence or intentional misconduct. This release applies to Earth & Elevate Movement Studio LLC and E&E Booster Club, and their respective owners, members, managers, officers, employees, independent contractors, guest instructors, volunteers, agents, representatives, successors, assigns, affiliates, and any other individuals or entities engaged by Earth & Elevate in connection with the Activities. I agree that if I bring a lawsuit or claim in violation of this agreement, I shall be liable to Earth & Elevate for reasonable attorneys’ fees and expenses incurred in defending such claims. I represent and warrant that I have read and fully understand this document, that my representations are truthful and accurate, and that I have had the opportunity to ask questions which have been answered to my satisfaction.

I grant permission to EARTH & ELEVATE MOVEMENT STUDIO LLC, E & E BOOSTER CLUB, AND EARTH & ELEVATE YOGA COOPERATIVE to take and use photos/videos of myself and/or my minor children to use for marketing, social media, and advertising.
